Formally under James Longstreet, and now under Major General Richard Anderson, the First Corps occupied the Confederate right and trailed off to the southeast.

Across the some 400 yards of open ground was a low rise called Laurel Hill where Fitzhugh Lee's Confederate troopers were busily digging in preparation for making a stand. Lee's men would not be fighting on their own. Confederate infantrymen of Anderson's First Corps had been on the move during the early morning of the eighth as well, reaching Old Court House between 0700 and 0800.
